Terms of Service
These terms govern your use of Meridian, listed on the App Store as "Country Days Tracker: Meridian."
Effective 15 August 2026
Meridian is not tax, legal or immigration advice. It is a counting tool. The numbers it produces are estimates based on the location data available to it and on the information you enter. Residency and visa rules are complex, change over time, and turn on facts the app cannot see. Before making any decision that depends on a day count — filing a return, booking a trip near a limit, claiming or disclaiming residency — verify the figures yourself and consult a qualified professional.
1. Acceptance
These terms are a binding agreement between you and Damir Zhambylov, operating as Meridian ("we," "us," "our"). By downloading, installing or using the app, you agree to be bound by them. If you do not agree, do not use the app.
2. Eligibility
By using Meridian, you represent that you are old enough to hold a valid passport or government-issued ID in your own right under the law of your country. The app is not directed at children and is not designed for use by them.
3. Licence
You are granted a personal, non-exclusive, non-transferable, revocable licence to use Meridian on Apple devices you own or control, in accordance with the App Store Terms of Service, solely for your own personal use.
You may not: copy, modify, reverse engineer, resell or redistribute the app; attempt to extract its bundled datasets for other purposes; make the app available over a network for use by multiple people or devices; or use the app, its content or its design as the basis for a competing product.
All content in the app — its code, design, datasets and trademarks — belongs to us or our licensors. Nothing in these terms transfers ownership of any of it to you.
4. Prohibited activities
You agree not to:
- access the app through a bot, script, or other automated or non-human means;
- attempt to bypass, disable, or interfere with the subscription or entitlement checks that gate paid features;
- use the app for any purpose that violates applicable law; or
- interfere with or place an undue burden on the app or the services it depends on (Apple's servers, RevenueCat).
5. What the app does, and its limits
Meridian counts days spent in countries and compares them against rules you choose — the Schengen 90/180 limit, the UK Statutory Residence Test, the US Substantial Presence Test, and a generic 183-day threshold for other countries.
You are responsible for the accuracy of your own record. Counts can be wrong for reasons outside our control, including:
- location permission denied, restricted to "While Using", or switched off;
- the device being off, in airplane mode, or out of battery when a border is crossed;
- photos without location tags, or photos taken by other people in your library;
- trips entered or edited incorrectly by you;
- iOS restricting background activity to save power;
- rules changing, or your circumstances falling outside the standard tests the app models.
The app surfaces gaps in its record where it can detect them, but it cannot guarantee that it has caught every crossing. Treat its output as a well-informed estimate that you check, not as an authoritative statement of your legal position.
6. Subscriptions
Meridian is free to use with a limited feature set. A paid subscription, Meridian Pro, unlocks unlimited country rules, unlimited documents, and PDF/CSV export.
- Subscriptions are billed through your Apple ID at the price shown in the app for your region at the time of purchase. Apple, not us, sets and collects any applicable tax.
- Where offered, a free trial runs for the period stated on the paywall (3 days at launch). Buying a subscription before the trial ends forfeits the unused portion.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours of the end of the current period.
- If we raise the price of an active subscription, Apple requires your explicit consent before the new price applies to you — it is never charged silently.
- You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → your name → Subscriptions) — not by contacting us; we have no ability to cancel it on your behalf. Deleting the app does not cancel a subscription.
- Purchases can be restored on the paywall screen, reachable from Settings → Subscription.
Refunds are handled by Apple, not by us, under Apple's refund policy at reportaproblem.apple.com. We cannot issue refunds directly, but write to us if something has gone wrong and we will help where we can.
7. App Store terms
These additional terms apply because the app is distributed through the App Store:
- Apple has no obligation to provide any maintenance or support for the app — that is on us, and you should contact us, not Apple, with problems.
- Apple's only warranty obligation, if any, is to refund the purchase price under its own policies; it has no further warranty obligation of any kind.
- You represent that you are not located in a country subject to a US government embargo or designated as "terrorist-supporting," and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you directly.
8. Availability and changes
Features may change, and paid features may be added, altered or withdrawn over time. If a change materially reduces what an active subscription provides, we will say so in the release notes. We do not guarantee uninterrupted availability; the app is designed to work offline, but the App Store, Apple's purchase infrastructure and subscription verification are outside our control.
9. Your data
Your trips, rules, passports and documents are stored on your device, not on our servers. We do not maintain a copy and do not back it up — there is nothing on our side to recover if you delete the app, delete your data, or lose the device without a backup of your own. iOS device backups (iCloud or a computer backup) cover it if you have them enabled; that is between you and Apple, not us. Keep your own export if the record matters to you. See the Privacy Policy for details.
10. Indemnification
You agree to defend and hold us harmless from any claim or demand, including reasonable legal fees, arising from your breach of these terms, your violation of any law, or your violation of a third party's rights through your use of the app.
11. Disclaimer of warranties
Meridian is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that day counts, rule evaluations, notifications or exports will be error-free or complete.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, tax reliefs, immigration status or opportunity, arising from your use of or inability to use Meridian — including any penalty, back tax, overstay consequence or refused entry connected with a day count. Our total aggregate liability is limited to the amount you paid for the app in the twelve months before the claim arose.
Any claim arising from these terms or your use of the app must be brought within one year of the event giving rise to it, or it is permanently barred, to the extent this is permitted by law.
Nothing in these terms excludes liability that cannot lawfully be excluded.
13. Termination
You may stop using Meridian at any time by deleting the app. We may restrict or deny your access to the app if these terms are breached. Sections 5, 9, 11, 12 and 14 survive termination.
14. Governing law
These terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of mandatory consumer-protection rules of the country where you live.
15. Dispute resolution
Disputes arising from these terms are subject to the jurisdiction of the courts of Astana, Kazakhstan. We also retain the right to bring a claim in the courts of the country where you reside.
16. Miscellaneous
These terms, together with the Privacy Policy, are the entire agreement between us about the app. If any part of them is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
17. California users
If a complaint with us is not resolved to your satisfaction, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210 or (916) 445-1254.
18. Changes to these terms
Updated terms are published on this page with a new effective date. Continuing to use the app after that date means you accept the revised terms.
